The Open Network Society (TON), an independent group advocating for the TON community, has issued a forceful open letter to French authorities demanding the immediate release of Pavel Durov, co-founder of Telegram, who was arrested at Le Bourget Airport on August 24. The arrest has sparked a significant uproar within the global tech and crypto communities, highlighting concerns over freedom of speech and human rights.

Pavel Durov’s arrest occurred under circumstances that TON Society and various supporters have labeled as an infringement on fundamental human rights. French officials extended his detention until August 28, pending further investigation into allegations involving an unnamed user of Telegram engaging in illegal activities via the platform.

A Call for Human Rights and Free Speech

In its open letter, TON Society articulates a strong condemnation of Durov’s imprisonment, labeling it a “direct assault on a basic human right” and a breach of free speech principles. The letter highlights:

  • The importance of encryption measures in protecting freedom of expression, referencing a precedent from the European Court of Human Rights (ECHR) in the Case of Podchasov v. Russia.
  • A call to action for supranational organizations such as the United Nations, the Council of Europe, and the European Union to intervene and advocate for Durov’s release and for France to adhere to human rights standards.

The arrest has elicited a swift and widespread response from the crypto community and advocates of free speech, with many viewing the French government’s actions as overly aggressive and politically motivated, despite official statements to the contrary. President Emmanuel Macron’s assurances that the arrest was not political in nature did little to quell the backlash, with many in the online community and tech industry expressing increased concern for their own safety and the state of free speech in Europe.

In the wake of the arrest, Chris Pavlovski, CEO and founder of Rumble, fled Europe, citing fears of similar treatment by French authorities towards other tech executives associated with free speech initiatives. TON Society’s Advocacy and Telegram’s Compliance

They argue that the platform’s approach to user privacy and information management should not be misconstrued as non-compliance or defiance.
